why do my husbands photos and contacts appear on my phone. I think we share the same email address on icloud but do not know if that is the problem and if so how to fix it. I have an iphone 4 and he has a 5

If you share the same AppleID, and have iCloud Photo storage turned on and sync your contacts, this is exactly what will happen.
One of you, likely you, should create your own unique AppleID.

Stop sharing an iCloud account. They are not meant to be shared.
To keep things seperate, each of you should have a seperate Apple ID and iCloud account.
To share purchases, etc, one of you can set up Family Sharing.
